BATHINDA: A letter of Union health and family welfare ministry , seeking a report on slain Punjabi singer-rapper’s mother going in for IVF technique in conceiving a child at the age of 58, surfaced a day after father Balkaur Singh accused Punjab govt of harassingthem over legal status of their newborn.Moose Wala’s mother Charan Kaur had delivered the baby at a hospital in Bathinda on Sunday. The letter mentions that conceiving a child through IVF is allowed only for women from 21 to 50 years of age. “Under Section 21 (g) (i) of the Assisted Reproductive Technology (Regulation) Act, 2021, the age limit prescribed for a woman undergoing ART services is between 21-50 years. It is requested to look into the matter and submit a report to the department of action taken in the case as per the ART (Regulation) Act, 2021,” the letter by SK Ranjan, director, ART and surrogacy division, department of health research, Union ministry of health and family welfare, of March 14, stated. It is addressed to principal secretary, department of health and family welfare, Punjab.Violation of provisions of the Act attract a fine of Rs 5-10 lakh and subsequent violations could attract imprisonment of 3-8 years along with fine of Rs 10-20 lakh. However, HS Phoolka, advocate in SC and ex Punjab leader of opposition, rejected the Centre’s stance on the issue.“Govt has no power to question any couple. Under ART Act, 2021, conditions apply only to clinics. Restrictions under Sec 21 apply to clinics only. Hence, govt cannot question,” he tweeted on Wednesday.
